Scope
These General Terms and Conditions (GTC) govern the legal relationship for all rentals of sauna appointments by Löyly GmbH, Address/Location to be completed (hereinafter "Landlord") to customers via the website www.loyly.ch (hereinafter "Website") or other channels.
The sauna rules are considered integral parts of these GTC. They are available on the website.
Subject of the Contract
The landlord rents sauna appointments to the customer via the website for the prices specified on the website at the sauna facilities operated by him.
Booking and Payment
The booking of sauna appointments usually takes place through the landlord's website. Bookings through other agreed communication channels, such as phone or WhatsApp/SMS, are also possible. Payment for the rented sauna slots is made through the payment options offered on the website. Payment is due in advance and must be made before the booked sauna appointment.
Cancellation and Refund
A cancellation of a booking is possible up to 24 hours before the start of the booked sauna appointment. Late cancellations or no-shows are chargeable and will not be refunded.
Usage
The use of the sauna facilities is at one's own risk. The sauna facilities should only be used by persons who are physically healthy and free from contagious diseases.
Liability
The use of the landlord's offerings, especially the use of the sauna facilities and equipment, is at one's own risk and own peril. The landlord excludes any liability for direct and indirect damages, to the extent permitted by law.
The landlord is not liable for the loss of items, valuables, money, clothing, or other items brought along for the sauna visit.
The customer is liable for any damages caused to the sauna facilities and their equipment. He must fully reimburse the landlord for the corresponding repair and/or replacement costs.
Any cooling off and swimming in water around the sauna facilities is at one's own risk, any liability in this regard is declined.
The landlord assumes no liability for the temporary unavailability of the sauna facilities due to repair or maintenance work, nor for circumstances that are beyond the landlord's control (e.g., force majeure). The information provided on the landlord's website does not constitute guarantees. The landlord's website may contain external links, the content of which the landlord has no influence over. Therefore, the landlord assumes no liability for the content of these external links.
Operating Hours
The sauna facilities are available to the customer during the bookable slots for rental. The locations, operating hours, and features of the landlord's sauna facilities may change at any time.
Data Protection
The collection and processing of personal data is carried out in accordance with the privacy policy. This constitutes an integral part of these GTC. The privacy policy is available online, currently at www.loyly.ch/datenschutz. By booking, the customer accepts the processing of his personal data as outlined in the privacy policy.
Modification of the GTC
The landlord reserves the right to change these GTC at any time. The modified GTC will apply from their publication on the landlord's website.
9. Severability Clause
If any provision of these GTC is ineffective, the remaining provisions shall remain unaffected.
Applicable Law and Jurisdiction
Disputes in connection with these GTC and the business relationships between the customer and the landlord are subject solely to substantive Swiss law. The exclusive jurisdiction for all disputes arising from or in connection with these GTC and the contractual relationship between the customer and the landlord is Zurich, Switzerland.
